Last week, the National Indian Gaming Commission issued a final decision order regarding the Civil Fine Assessment in the amount of $2.6 million against Mr. Edward Street and Oakland Enterprises LLC for management of a tribal casino without a contract approved by the NIGC Chairman, as required in 25 U.S.C. § 2711.

Between November of 1999 and February of 2006, Mr. Street through his limited liability company, Oakland Enterprises performed day-to-day operations at the Tonkawa Bingo and Casino. The Commission found that the Chairman's decision to issue the CFA was supported by ample evidence and that the amount of the fine was appropriate based on the weighing of factors as required by NIGC regulations.

Chairman Hogen stated "this is a substantial violation and the fine amount indicates how serious the Commission views the managing of a tribal gaming facility without an approved contract."
